THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

1. Our Legal Duty

One Clear Test LLC (“Company,” “we,” “our,” or “us”) is required by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and applicable federal and state laws to:

  • Maintain the privacy and security of your Protected Health Information (“PHI”)

  • Provide you with this Notice of our legal duties and privacy practices

  • Notify you in the event of a breach of unsecured PHI

  • Follow the terms of the Notice currently in effect

We reserve the right to change this Privacy Policy at any time and to make the revised Notice effective for all PHI we maintain.

2. What Is Protected Health Information (PHI)?

Protected Health Information (PHI) includes any individually identifiable information related to:

  • Drug and alcohol testing results

  • Medical review information

  • Date of birth

  • Identification numbers

  • Contact information

  • Employer-related testing documentation

  • Any health-related information collected during testing

PHI may exist in oral, written, or electronic form.

3. How We May Use and Disclose Your PHI

We may use or disclose your PHI without written authorization for the following purposes:

A. Treatment

We may use PHI to provide testing services and communicate with laboratories, Medical Review Officers (MROs), Breath Alcohol Technicians (BATs), or other healthcare professionals involved in your testing process.

B. Payment

We may use and disclose PHI to:

  • Bill employers or individuals

  • Process payments

  • Verify insurance coverage (if applicable)

  • Collect outstanding balances

  • ​

C. Healthcare Operations

We may use PHI for business operations such as:

  • Quality assurance

  • Staff training

  • Licensing and accreditation

  • Compliance monitoring

  • Audits

  • ​

D. As Required by Law

We may disclose PHI when required by federal, state, or local law, including:

  • Department of Transportation (DOT) regulations

  • Court orders or subpoenas

  • Government inspections

  • Law enforcement requests

  • Workers’ compensation reporting

E. Public Health and Safety

We may disclose PHI to prevent or lessen a serious threat to health or safety as permitted by law.

4. Disclosures to Employers

For workplace drug and alcohol testing:

  • Results may be disclosed to the Designated Employer Representative (DER) or authorized employer contact.

  • DOT-regulated testing results are reported in accordance with 49 CFR Part 40.

  • Non-DOT testing results are disclosed as authorized by employer agreements and applicable law.

Your employer may receive results as permitted under workplace testing laws and regulations.

5. Uses and Disclosures Requiring Your Written Authorization

We will not use or disclose your PHI for the following without your written authorization:

  • Marketing purposes

  • Sale of PHI

  • Any disclosures not described in this Notice

You may revoke your authorization in writing at any time, except to the extent that action has already been taken.

6. Your Rights Under HIPAA

You have the following rights regarding your PHI:

A. Right to Access

You may request a copy of your PHI. Requests must be submitted in writing. We may charge a reasonable fee for copies.

B. Right to Amend

If you believe information in your record is incorrect or incomplete, you may request an amendment in writing. We may deny the request under certain circumstances, but you will be informed in writing.

C. Right to an Accounting of Disclosures

You may request a list of disclosures made of your PHI, except those related to treatment, payment, healthcare operations, or authorized disclosures.

D. Right to Request Restrictions

You may request restrictions on certain uses or disclosures of your PHI. We are not required to agree to all requested restrictions but will comply if required by law.

You may request that we communicate with you in a specific manner (e.g., alternative phone number or mailing address).

For mobile testing services:

  • Results are transmitted securely to authorized recipients

  • Testing records are maintained in accordance with regulatory retention requirements

We retain records in accordance with:

  • DOT regulations

  • State law

  • Federal compliance requirements

Retention periods vary depending on the type of test and regulatory classification.

11. Complaints
